TERMS OF SERVICE : THE SHFT LAB Co.

These Terms of Service (“Terms”) govern your access to and use of THE SHFT LAB Co.’s websites, programs, events, digital products, community spaces, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1) Who We Are
THE SHFT LAB Co. (“THE SHFT LAB,” “we,” “us,” “our”) provides coaching, education, live events, community, and digital products.
THE SHFT LAB may operate and offer Services under affiliated brand names and programs, including The C.U.R.E. Collective and The Brave Collective (collectively, the “Affiliated Brands”). These Terms apply to all Services offered by THE SHFT LAB and its Affiliated Brands unless a specific product or program includes separate written terms.

2) Eligibility
You must be at least 21 years old to use the Services or participate in our programs/events unless we explicitly agree otherwise in writing.
3) Scope of Services
Services may include coaching, educational content, retreats/workshops and programs (including UNVEIL and Fear Gone Academy), digital products, email communications delivered via Kajabi, community access via Skool, scheduling coordination via Google, and payment processing via Stripe.
4) Coaching + Not Medical Care
THE SHFT LAB provides coaching, education, and personal development experiences. We are not a medical provider, mental health provider, or crisis service, and nothing in the Services is medical, psychological, or psychiatric advice.
You are responsible for your own decisions, actions, and results.
If you are experiencing a mental health crisis or believe you may be in danger, do not use our Services for emergency help. Contact local emergency services or a licensed provider.
Some exercises may be emotionally intense. Participation is voluntary and at your discretion.
5) Assumption of Risk
By participating in our Services (including live events and retreats), you voluntarily assume all risks associated with participation, including physical, emotional, or psychological discomfort.
You agree to participate in a safe and responsible manner and to follow any posted or stated safety guidelines during events.
6) Community Rules and Conduct (Including Skool)
If you access community spaces or interact with other participants, you agree to:
Be respectful and act in good faith
Not harass, threaten, stalk, shame, or abuse others
Not post illegal, hateful, defamatory, sexually explicit, or violent content
Not share another person’s private information without consent
Not record, screenshot, or redistribute private community content unless explicitly authorized
Not solicit, recruit, or sell to community members without written permission
We may remove content or suspend/terminate access at our sole discretion if conduct violates these Terms or harms the community.
7) Accounts and Access
If you create an account or receive login access:
You are responsible for maintaining the confidentiality of your login
You are responsible for all activity under your account
You agree to provide accurate, current information
8) Payments, Billing, and Payment Plans
Payments are processed through Stripe. By purchasing, you agree to:
Pay all fees and applicable taxes
Provide current, accurate billing information
Authorize charges to your selected payment method
Payment Plans: If you enroll using a payment plan, you authorize recurring charges until the plan is completed. If a payment fails, we may suspend access until the account is current.
9) Refund Policy (Read Carefully)
Refund policies are offer-specific and disclosed at the point of purchase. Unless otherwise stated in writing, the following apply:
(a) Digital Products
All digital product sales are final. No refunds.
(b) Live Events and Programs
Refund Window: Refund requests must be submitted in writing at least 10 days prior to the event start date to be eligible.
No Refunds Inside 10 Days: Requests made within 10 days of the event are not refundable.
Transfer/Credit Option: If you cannot attend, you may request a one-time transfer of your registration to a future event date (or a credit toward a future event) if:
the request is made before the event start date,
the transfer/credit is used within 12 months, and
the transfer applies to the same event type (e.g., UNVEIL → UNVEIL or Fear Gone Academy → Fear Gone Academy), unless we approve otherwise in writing.
Transfer Fee: All approved transfers are subject to a $50 administrative transfer fee.
No-Show Policy: If you do not attend the event and do not notify us before the event start time, you forfeit your registration and are not eligible for a refund, transfer, or credit.
Abuse / Repeat Transfer Policy: We reserve the right, in our sole discretion, to deny transfer or credit requests in cases of repeated rescheduling, suspected abuse of this policy, or conduct that violates these Terms.
Transfers are subject to availability and scheduling. Travel costs, lodging booked independently, and third-party expenses are not our responsibility.
(c) Payment Plans
Payment plans are offered for convenience and do not change the refund policy above. If you commit to a payment plan, you are responsible for completing payments according to the agreed schedule unless otherwise stated in writing.
(d) Chargebacks / Payment Disputes
If you file a chargeback or payment dispute without first contacting us to attempt to resolve the issue, we may suspend access to Services and community spaces while the dispute is investigated.
10) Intellectual Property
All content provided through THE SHFT LAB Services—including frameworks, lesson materials, videos, worksheets, event content, writing, and branding—is owned by THE SHFT LAB or its licensors and protected by intellectual property laws.
You may not, without written permission:
Copy, reproduce, distribute, sell, or publicly display our content
Record live sessions/events (audio/video)
Create derivative works based on our materials
Reverse engineer, scrape, or attempt to extract proprietary content
We grant you a limited, non-transferable, revocable license to access purchased content for personal use only.
11) Confidentiality and Participant Information
Programs and community spaces may involve participants sharing personal experiences. You agree:
Not to disclose private information shared by others
Not to share screenshots, recordings, or private group content outside the community
Not to use participant information for solicitation, marketing, or recruitment
We will enforce community rules where violations occur, but you acknowledge we cannot guarantee other participants’ behavior.
12) Third-Party Platforms
Our Services may rely on third-party platforms including Stripe, Kajabi, Square Space, Skool, and Google. Your use of those platforms may also be governed by their terms and policies. We are not responsible for outages or interruptions caused by third parties.
13) Termination
We may suspend or terminate your access to the Services (without refund where allowed by law) if you:
violate these Terms
engage in harmful conduct
attempt to misuse, copy, or steal intellectual property
disrupt the community or event environment
You may stop using the Services at any time. If you are on a payment plan, you remain responsible for payments owed unless your specific agreement states otherwise.
14) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
We do not guarantee outcomes, results, or uninterrupted access.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
15) Limitation of Liability
To the maximum extent permitted by law, THE SHFT LAB will not be liable for any indirect, incidental, special, consequential, or punitive damages.
To the maximum extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount you paid to THE SHFT LAB for the specific product/service giving rise to the claim in the six (6) months prior to the event giving rise to the claim.
(Some states do not allow certain limitations; this applies only to the extent allowed.)
16) Indemnification
You agree to indemnify and hold harmless THE SHFT LAB and its team from claims, damages, losses, and expenses (including attorney’s fees) arising from your use of the Services, your violation of these Terms, or your infringement of any rights of another.
17) Changes to These Terms
We may update these Terms from time to time. The “Last updated” date reflects the most current version. Continued use of the Services after changes means you accept the revised Terms.
18) Governing Law and Venue
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.
Any dispute will be brought exclusively in the state or federal courts located in Michigan, and you consent to that jurisdiction and venue.
19) Entire Agreement / Severability / Waiver
These Terms (plus any purchase-specific terms you agree to) are the entire agreement between you and THE SHFT LAB regarding the Services.
If any provision is held invalid, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver of our right to enforce it later.
Certain Services may include additional program-specific terms (including waivers, safety rules, or participation guidelines). If presented at checkout, registration, or onboarding, those terms are incorporated into these Terms by reference.
